Power of Attorney

  If you are retired and your mental capacity is good, we strongly recommend that you consider setting up an Enduring Power of Attorney (EPA). They are really simple.
  Hopefully it will gather dust with your Will, but it could prove invaluable if you lose your capacity to deal with your finances. If this does happen and you don't have an EPA, your finances will fall under the control of the Court of Protection.  
  With an EPA, your nominated Attorney(s) (usually a close family member) would register with the Court of Protection and (subject to the Enduring Powers of Attorney Act 1985) be in control.  
  The Court of Protection is well meaning but incredibly restrictive, intrusive and cumbersome. We have seen it at close quarters and you wouldn't wish it on your family.
